Private sector workers who will report to work on November 1 (All Saints’ Day) and November 2 (All Souls’ Day) will receive an additional 30 percent in their salaries.

In an advisory, the Department of Labor and Employment (DOLE) said November 1 and 2 have been declared as special non-working days under Proclamation No. 555, series of 2018, issued by President Rodrigo Duterte.

The pay rules for November 1 and 2 provides that for work done on these days, an employee shall be paid an additional 30 percent of his/her basic wage on the first eight hours, or [(Basic Wage x 130%) + COLA].

If the employee worked in excess of eight hours (overtime), employee shall be paid an additional 30 percent of his/her hourly rate, or [(Hourly Rate of the basic wage x 130% x 130% x number of hours worked)].

For work done during these days that also fall on employee’s rest day, he/she shall be paid an additional 50 percent of his/her basic wage on the first eight hours, or [(Basic wage x 150%) + COLA].

For work done in excess of eight hours (overtime), an employee shall be paid an additional 30 percent of his/her hourly rate, or [(Hourly Rate of the basic wage x 150% x 130% x number of hours worked)].

At the same time, the DOLE noted that the ‘no work, no pay’ principle will apply, unless there is a favorable company policy, practice or collective bargaining agreement (CBA) granting payment on a special day.

The Malacañang proclamation was made to strengthen family ties by providing more time to observe their most cherished traditions, All Saints’ Day and All Souls’ Day. (PNA)
